How Mediation Works
The Process and Goal of Mediation
Mediation is conducted by a trained mediator who acts impartially to facilitate a settlement. In family law cases, only the lawyers and the client are allowed to be present. The parties are placed in separate rooms with the mediator going back-and-forth to exchange ideas and settlement offers. The parties are usually never in the same room. The primary goal is to reach a "Mediated Settlement Agreement" (MSA), which is legally binding. In some cases, a "Partial Mediated Settlement Agreement" may be achieved if all issues are not settled.
